Terms of Service — Voxelio

1. Agreement to Terms

By accessing or using the Voxelio mobile application, website, and related services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of Services

Voxelio provides AI-powered LiDAR and 3D capture tools for compatible devices, allowing you to scan spaces and objects and export data in formats such as USDZ, OBJ, and GLB. Features, availability, and export options may vary by device and plan.

3. Eligibility and Account

You must be at least 13 years of age (or the age of majority in your jurisdiction) to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and notify us of any unauthorized use.

4. Acceptable Use

You agree not to:

Use the Services in violation of any applicable law or third-party rights.
Scan, capture, or share content that infringes intellectual property or privacy rights.
Reverse engineer, decompile, or attempt to extract source code from our software.
Resell, sublicense, or commercially exploit the Services beyond permitted use.
Introduce malware, abuse system resources, or interfere with the integrity of the Services.

We may suspend or terminate access for conduct that we determine violates these Terms or is harmful to others or our Services.

5. Your Content and Data

You retain ownership of content you create using the Services (e.g., 3D scans and exports). By using the Services, you grant us a limited license to process, store, and transmit your content as necessary to provide and improve the Services, in accordance with our Privacy Policy. You are responsible for ensuring you have the right to capture and export any content you process.

6. Intellectual Property

Voxelio and its licensors own all rights in the Services, including software, design, and branding. These Terms do not grant you any right to our trademarks or other intellectual property except as necessary to use the Services as intended.

7. Payment and Subscriptions

If you purchase a subscription or other paid feature, you agree to the applicable pricing and payment terms. Fees are generally non-refundable unless required by law or our refund policy. We may change pricing with notice; continued use after a price change may constitute acceptance.

8. Disclaimers

The Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error-free operation, or that scan quality or export formats will meet your specific requirements.

9. Limitation of Liability

To the maximum extent permitted by law, Voxelio and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars (USD 100), whichever is greater.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access for violation of these Terms, for legal or regulatory reasons, or for operational necessity. Upon termination, your right to use the Services ceases; we may delete or retain your data as described in our Privacy Policy.

11. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Voxelio operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, except where prohibited.
